You agree to transfer funds only to and from your accounts in your name. If an error occurs on the coinzix.com platform or at the ATM when buying, selling or withdrawing digital coins and the amount received by you is higher than it should have, you are required to return the difference.

The execution of a transaction implies the cumulative fulfillment of the following conditions:

• the cryptocurrencies you sell do not come from illicit or illegal activities;
• the sale of digital currencies does not represent money laundering activity or any other method of financing terrorism;
• you are the holder of the account in which the bank transfer is made.

It is the User's responsibility to pay all fees and taxes due to the authorities resulting from his transactions, in accordance with the legislation applicable in his country of residence.

Chapter V. Processing of personal data

By filling in your data in the registration form on the platform or at the ATM, by providing the information requested during the identity verification process or by contacting us by any means (contact form, email, telephone, comments, social media networks, etc.) you understand that your personal data will be included in our database and will be processed under the electronic contract between the parties (Terms and Conditions), in order to respond to your requests, to improve our products and services. However, there is also the possibility for our company to send you commercial communications if you have made a transaction on our website at least once, based on the previous business relationship, based on the pursuit of our legitimate interest for marketing and advertising purposes [ art. 6/1/f of Regulation (EU) 2016/679].

You may not use fake email addresses/social media accounts, claiming to be someone other than who you are, or attempting to mislead Coinzix.com about your identity. You are directly responsible for any comments you post and for the accuracy of the information published both on our website as well as on, for example, social networks. Coinzix.com is not responsible and will not be liable for any comments posted by you or any third party.

Banking information is always encrypted using blockchain and encryption technologies when transmitted between different networks.

Coinzix takes all security measures to protect the personal information of its Users. By using the services provided by Coinzix.com, the User assumes responsibility for the information provided.

• you will notify Coinzix immediately if you become aware of any unauthorized use of the Account or any other breach of security rules;
• you will strictly follow all Coinzix mechanisms or procedures regarding security, authentication, trading, charging and withdrawal;
• you will take the appropriate steps to disconnect from Coinzix at the end of each visit.

You do not have the right to transmit any type of computer viruses or source code of a destructive nature.

Chapter VIII. Registration of a User account

By registering on the Coinzix.com platform, users will be facilitated access to the Cryptocurrency Exchange services we offer through our platform. From your account you will be able to track the exchange rate, to see the history of transactions made and much more.

All users must request a Coinzix account before they can use Coinzix Services. When you register a Coinzix account, you must provide your real name, email address and password and accept these Terms and Conditions as well as the Privacy Policy.

Coinzix may, in its sole discretion, refuse to open a Coinzix Account for you.

The information you provide when you open an account is complete and accurate and you agree to update it in a timely manner to maintain the integrity and accuracy of the information. Each user can open only one Coinzix Account.

After sending the registration form, you will receive an account activation link on the email communicated in the registration form. Attention: the account will be activated only after accessing the link received by e-mail, thus confirming that the e-mail address is valid and that you have access to that e-mail address.

We recommend that you consider the following features when setting passwords:

• contain both uppercase and lowercase letters (for example a-z and A-Z).
• contain special numbers and characters (e.g. !@#$%^&*()_+=}{:'?><).
• contain at least six alphanumeric characters.
• do not use a word in any language, jargon, dialect, etc.
• not be based on personal information, last name, etc.

Closing the Coinzix account

In the event of any of the situations set forth below, Coinzix will have the right to terminate these Terms and Conditions directly by suspending/canceling your Coinzix Account and will enjoy the right, but not the obligation, to permanently freeze (cancel) your Account authorizations. Coinzix:

• a user registered on the platform with the name of another person;
• the information you have provided is untrue, inaccurate, outdated or incomplete;
• when these Terms and Conditions are changed, you declare that you do not want to accept the changes by requesting the cancellation of your Coinzix Account;
• you request the termination of Coinzix services; or
• any other circumstances in which Coinzix considers that it should terminate Coinzix's services.
• you open a purchase transaction several times for which you do not prove payment

If your Coinzix account is suspended/closed, the account and transaction information to which the data retention obligation applies will be stored securely for 5 years from the date the account is suspended or closed.

Transactions not settled in an account that has been suspended or closed will be refunded at the request of the User provided that there is no legal obligation or court order to prevent the refund.

Coinzix retains full custody of digital assets, funds and user data / information that may be transmitted to government authorities in the event of suspension / closure of Coinzix accounts following fraud investigations, infringement investigations or breaches of these conditions.

You have the right to request that the Account be closed at any time. However, you remain responsible for all transactions made while the account was opened.

Chapter IX. Identity verification

In order to benefit from our services, we must have the certainty of your identity in order to comply with the applicable legal provisions.

Thus, on the site we implemented a two-level identity verification system, depending on the type of service you want to benefit from and the value of the transaction.

Level 1 will allow:

• Deposit and withdraw of cryptocurrencies until the value threshold equivalent to 25 BTC/day is reached
• Deposit and withdraw Fiat currency until the value threshold of EUR 10,000/month is reached

Level 2 will allow:

• Deposit and withdraw of cryptocurrencies until the value threshold equivalent to 50 BTC/day is reached
• Deposit and withdraw Fiat currency until the value threshold of EUR 500000/month is reached

At the ATM there are also 2 levels depending on the value of the transaction:

Level 1 trading will allow:

• Sale of cryptocurrencies up to the trading value threshold of RON 5,000 / day
• Purchase of cryptocurrencies up to the trading value threshold of RON 5,000 / day

Level 2 trading will allow:

• Sale of cryptocurrencies up to the trading value threshold of RON 10,000 / day
• Purchase of cryptocurrencies up to the trading value threshold of RON 10,000 / day

Personal data necessary to verify identity on the site:

Level 1:

• Identification data: age, sex, phone no., address, city, region (county), country, place of birth;
• Bank details: bank, account number (IBAN) and SWIFT code;
• Identification document: uploading the identity card
• Selfie;
• Liveness test;
• Proof of address

Level 2:

• Level 1 plus Documents regarding the source of funds

Personal data necessary to verify identity at the ATM:

Level 1 trading:

• Phone number

Level 2 trading:

• Identification data: last name, first name, phone no., email
• Identification document: uploading the identity card
• Selfie picture

This information will be used to verify the identity of Users in order to prevent, detect or investigate money laundering or terrorist financing, fraud and other financial crimes through Coinzix or for other legal purposes declared by Coinzix. We will collect, use and share this information in accordance with our Privacy Policy. In addition to providing this information, you agree to allow us to keep a record of that information during the period for which your account is active and within five (5) years of closing your account, in accordance with the legal regulations regarding preventing and combating money laundering and terrorist financing.

When you provide the requested information, you confirm that it is true and accurate. After verifying your identity, you need to make sure that your information remains true, complete, and up-to-date when it is changed. If we suspect that the information you have provided to us is incorrect, false, outdated or incomplete, Coinzix reserves the right to send you a notice to request correction, to delete that information directly and, if necessary, to order the full or partial restriction of the Coinzix services we offer you.

By initiating the identity verification process, you authorize Coinzix to conduct investigations that Coinzix deems necessary, directly or through a third party, to verify your identity or to protect you, to protect other users and / or to protect Coinzix from fraud or other financial crimes and to take the necessary measures based on the results of such investigations.

You also acknowledge and agree that your personal information may be disclosed to credit bureaus and fraud prevention or financial crime prevention agencies, which may respond to our investigations in full.

Coinzix may conduct investigations in the following cases:

• Your Coinzix account is subject to government proceedings, criminal investigations or other pending litigation;
• We detect unusual activities in your Coinzix account;
• We detect unauthorized access to your Coinzix account;
• We are required to do so by a court order or order of a regulatory authority / government.

Chapter X. Using the account

The Coinzix account can only be used by the account applicant. Coinzix reserves the right to suspend, freeze or cancel the use of Coinzix accounts by persons other than the account applicant. If you suspect or are aware of any unauthorized use of your username and password, you should notify Coinzix immediately at [email protected]. Coinzix assumes no liability for any loss or damage resulting from the use of your Coinzix account by any third party with or without your permission.

Chapter XI. Use of Coinzix Services

After completing the registration and identity verification for your Coinzix account, you can begin to enjoy the simplicity of instant cryptocurrency trading, including, but not limited to:

• Crypto trading

When placing a Crypto trading order, an order will be automatically opened, which will be placed in the database of our site in order to be connected to an order of the opposite direction opened by another user. If an order is executed or partially executed with the order of another user Coinzix will execute an exchange of coins between the two. After the exchange is complete or partially complete, the user's account will be updated to reflect that the completion of the order has ended or is only partially completed. An order completed only partially will remain open until it is fully executed or until the user wishes to close it.

• Fiat Trading

Trading with fiat refers to the same procedure as in the case of crypto trading, only this time the exchange will be made between a virtual currency and a fiat currency.

• Stacking

• Coinzix provides users with staking programs for certain virtual currencies. According to certain rules, the users of this service will obtain rewards representing a number of virtual coins of the same type.
• Coinzix does not guarantee the rewards of users within any staking program.
• Staking service is free
• Coinzix has the right at any time to cancel or change the rules of the staking service for any currency.

If you have opted for payment by card and this transaction is pending with our payment processor, the transaction will be delayed until payment is confirmed by the partner payment processor. Also, the payment processor MoonPay Limited Ltd will take care of the transfer of cryptocurrencies to you. Visa or MasterCard credit or debit cards with 3D Secure and Apple Pay can be used.

Attention: The purchase transactions with the card on the site are made according to the rules of Moon Pay LTD.

While using Coinzix services, all activities you conduct should comply with the requirements of applicable laws and regulations, these Terms and Conditions and the various Coinzix guidelines.

Your use of Coinzix services should not infringe the public or legitimate interests of others, including any actions that may interfere with, disrupt, disturb, adversely affect or prohibit other users from using Coinzix services.

You agree not to use the services for market manipulation (such as pump and dump, wash trading, self-trading, front running, quote stuffing, and spoofing or layering), whether or not prohibited by law.

Deposits and withdrawals from Coinzix account:

The deposit or withdrawal process can be done by fiat currency or virtual currency:

Fiat deposit and withdrawals:

• by SEPA transfer to the partner bank in Lithuania NexPay UAB (EURO), the bank licensed in transfers related to cryptocurrencies.
• by card payment to a payment processor (RON) [Moon Pay Limited (Malta)]
• direct cash at our ATM (RON)

Crypto deposit and withdrawals:

• By transferring virtual currency to or from crypto addresses available in the user account.
• The amount transferred will be lost if the address of the wallet in which the transfer is made is incorrect. Coinzix is not responsible if the customer sends the digital coins to a wrong address.

Limits

Coinzix may impose value limits on the use of the account, subject to the level of identity verification:

• Level 1

• Deposit and withdraw of cryptocurrencies until the value threshold equivalent to 25 BTC/day is reached
• Deposit and withdraw Fiat currency until the value threshold of EUR 10,000/month is reached

• Level 2

• Deposit and withdraw of cryptocurrencies until the value threshold equivalent to 50 BTC/day is reached
• Deposit and withdraw Fiat currency until the value threshold of EUR 500000/month is reached

At the ATM the limits are as follows:

• Trading level 1: 5000 RON / day
• Trading level 2: 5000-10000 RON / day

Canceling an order

Being an instant exchange orders initiated through the Coinzix platform can be canceled if they have not been fully processed. Coinzix assumes no responsibility for any loss or damage resulting from the placing of an Order. However, if you immediately realize that you made a mistake, please notify our support department immediately at [email protected].

We reserve the right to refuse the processing, cancellation or reversal of any virtual currency transaction made through our platform (sale / purchase of cryptocurrencies or instant crypto to crypto exchange) at our discretion.

Trading course

In the case of purchase transactions paid by payment by card, or directly cash at our ATM, the purchase rate is set at the time of initiating the transaction.

Fees

By using the Coinzix platform you agree to pay the commissions specified on https://coinzix.com/fees. Coinzix may, at its discretion, update the fees at any time. Any update of the fees will apply to any transactions that occur after the effective date of the updated fees. You authorize Coinzix to deduct from your account any applicable fees you owe in accordance with these Terms and Conditions.

Duration of a transaction

On average, the processing of a crypto transaction is done instantly. This duration may vary depending on the congestion of cryptocurrency networks.

In case of FIAT storage or withdrawal by SEPA transfer, it usually does not take more than 24 hours.

Chapter XII. Risks

The risks of cryptocurrency trading are mainly related to its volatility. Trading cryptocurrency involves a high and speculative risk and it is important to understand the risks before you start trading.

• They are volatile: unexpected changes in market sentiment can lead to sudden and significant price movements. It is not uncommon for cryptocurrencies to drop rapidly by hundreds, if not even thousands of dollars.
• They are unregulated: cryptocurrencies are currently unregulated by both governments and central banks. However, they have recently begun to attract more attention. For example, there are questions about their classification as a commodity or virtual currency.
• They are susceptible to error and hacking: there is no perfect way to prevent technical glitches, human error or hacking.
• Changes in cryptocurrency protocols: cryptocurrency trading presents additional risks, such as Hard fork or interruption. You should familiarize yourself with these risks before trading these products. When a Hard fork occurs, there can be substantial price volatility around the event and we can suspend trading for the duration of the instability.

We will endeavor to notify you of potential blockchain forks. However, in the end it is your responsibility to make sure that you find out when they might occur.

You agree to indemnify Coinzix operators, their affiliates, licensors and their representatives and agents against any claims, actions, proceedings, investigations, lawsuits, costs, expenses and damages (including attorney's fees, fines or penalties) imposed by any regulatory authority resulting from or in connection with:

• how you use or your conduct in connection with the functions and services offered by Coinzix;
• your breach or execution by Coinzix of these Terms and Conditions;
• breach of any laws, regulations or rights of any third party while using Coinzix services.

• to violate international, federal, local laws, rules, general laws or other local ordinances;
• to violate or disregard our intellectual property rights or those of others;
• to harass, abuse, insult, injure, defame, slander, denigrate, intimidate or discriminate on the basis of sex, sexual orientation, religion, ethnicity, race, age, nationality or disability;
• to publish false information or to intentionally mislead by information;
• to publish or transmit computer viruses or any type of malicious code that could affect the functionalities or operations of coinzix.com or of partner sites and / or under the umbrella of coinzix.com;
• to collect or monitor the personal information of others;
• to cheat, to commit a virtual crime using various internationally prohibited methods;

Coinzix cannot be held liable for damages or losses, or financial losses, or other direct or indirect losses, unless the damage results from recklessness, intentional misinformation or fraud committed by Coinzix.

By creating and using the Account, the User assumes responsibility for maintaining the confidentiality of the Account data (user and password) and for managing access to the Account and, to the extent permitted by applicable law, is responsible for the activity carried out through his Account.

By creating the Account and/or using the Content and/or making transactions, the User expressly and unequivocally accepts the Terms and Conditions of the Site, in the latest updated version, which is communicated within the Site, existing at the time of creating the Account and/or using the content and/or on the date of placing the Order.

The information included on the Coinzix.com site is for information purposes only and is made available in good faith from sources that Coinzix considers reliable. Chapter XVIII. Closing the responsibilities of the parties

The responsibilities and obligations of the Contracting Parties under these Terms and Conditions shall remain applicable until such time when the Agreement is terminated by either Party. You may terminate your compliance with the Terms and Conditions at any time by giving direct notice to coinzix.com, stating that you do not wish to continue to do so, or by ceasing to access our online platform.

If, in our judgment, we believe that you have violated or suspect that you have violated one or more provisions, we reserve the right to suspend or permanently terminate your access to coinzix.com without prior notice, you being liable for damages or responsibilities acquired while using our online platform, including the date of suspension or permanent cessation of access.

Chapter XIX. Force majeure

Neither party will be liable for non-performance of its contractual obligations if such non-non-performance is due to force majeure. Force majeure is the unpredictable event, beyond the control of the parties and which cannot be avoided.

Chapter XX. Settlement of disputes. Applicable law
